As an agency,
someone else's fraud....
....Can now become YOUR liability.
With OPRaaS, agencies learn to identify supply chain risks and
build the compliance evidence that protects your business from HMRC action.
Agencies:
The Risk You Can’t Afford to Ignore
As an agency, directly engaging temporary or contract workers through agencies or umbrella companies to meet short-term or project-specific needs, you’re now in HMRC’s sights to be held directly accountable for failures in compliance through the whole chain.
From April 2026, you could be held strictly liable for any unpaid PAYE or NICs throughout – There’s no statutory defence – even if the supplier committed the breach.
Risks You Inherit:
- Payslip skimming & disguised remuneration
- Mini umbrella fraud (MUC) & fake VAT invoices
- Criminal Liability under CFA 2017: Prosecution for failing to prevent tax evasion
- IR35 and CIS Misclassification: PAYE/NIC liabilities from status errors
- Non-compliant umbrella models: Mini-umbrellas, loan schemes, payslip skimming
HMRC’s Warning:
“Failing to take reasonable action to ensure your supply of labour is legitimate can lead to serious legal, financial and reputational risks.” — HMRC Supply Chain Due Diligence Principles
6 April 2026: The Law Changes
Under Joint & Several Liability, recruitment agencies become legally liable for unpaid PAYE and NICs when umbrella companies in their supply chain default. There is no statutory defence.

DEBT TRANSFER
HMRC can transfer unpaid umbrella tax debts directly to your agency
VAT DENIAL
Under Kittel, lose input VAT recovery if linked to supply chain fraud
CRIMINAL LIABILITY
CFA 2017 prosecution for failing to prevent tax evasion
Your PSL Is Not Protection
Your Preferred Supplier List may look compliant on paper. But if one umbrella on that list fails to pay its taxes, abuses payslips, or uses a loan scheme — HMRC can pass the entire liability to your agency.
Accreditation badges and promises aren’t enough. You need documented due diligence and auditable evidence of reasonable care.
Failing to take reasonable action to ensure your supply of labour is legitimate can lead to serious legal, financial and reputational risks.
